September 29, 2015
The cut-offs for filling date which were announced previously have been taken back significantly.  On 25th September, the US state department has issued Visa Bulletin for October which is revised.  This revised bulletin contains new and previous dates for filling cut-off than those which contains in the original October Visa Bulletin which was released on 9th September.

Department of State for US reissues the Visa Bulletin for October

The cut-off dates for new filing are in fact in response to the concerns that were raised by the Citizenship and Immigration Services of the US (USCIS). The concerns were about the date’s ability of processing a huge number of status adjustment applications.

The new bulletin succeeds the October’s Original bulletin, which restricts the cut-off dates for the first time filing that allows the filing of the status adjustment applications before numbers for visa were available. The cut-off dates for filing that are adjusted can be identified in the given chart by USCIS.  This alert mainly focuses on the dates of Employment-Based filing only.

The revised cut-off dates for filing will minimize the number of status adjustment for application that could be filed on 1st October. This development came as an unpleasant surprise for many people who have planned to file such status adjustment for application on this date. Especially in the categories of EB-2 India, EB-2 China, EB-3 Philippines.  Also note that the cut-off dates for final approval in the preference categories of EB remains unchanged.
