US Lawmakers Bothered About Increase in H1B Visas Request for Evidence


They were pointing to the dramatic rise in request for evidence for H-1B visa appeals for international workers. The U.S. Immigration and Naturalization Service (U.S.C.I.S.) makes a query called a request for evidence, or R.F.E. when they need additional proof to decide on an H1B case. 

The US H-1B visa is a non-immigrant visa that enables U.S. firms to employ international workers in specialty professions that require technical or theoretical expertise. 

The tech economy in Toronto is rising quicker than the tech economy in Washington and Silicon Valley. A lot of individuals think it's because of the U.S.C.I.S. and immigration policies, Susan Ellen Lofgren, Congresswoman, said on 17 Jul 2019 during a congressional hearing on Immigration and Citizenship Policy Changes and Delays in the Processing. 

A spike in additional Requests for Evidence (R.F.E.s) from the agency stops case processing and diminishes adjudication resources, told Marketa Lindt, president, Association of American Immigration Lawyers.

Tremendous Growth in Requests for Evidence for H1B Visas


In the opening quarter of 2019, U.S. Citizenship and Immigration Services announced R.F.E.s to 60% of H-1B appeals, dramatically higher than the 20.8% H-1B R.F.E rate in the financial year 2016. 

As per the U.S.C.I.S. official, the rise is due to the number of reforms that have been made. 

It is easily predictable that we will have a raise in the request for evidence, perhaps an increase in rejections, the official told. The R.F.E.s are particularly bothering that because it attaches a whole uncertainty level, both in terms of timeline and outcome, to staffing these critical positions, Lindt said.
