CIC introduced new system for work permit applications under LMIA exemption

October 28, 2015
Canadian Citizenship and Immigration (CIC) have introduced the new system for the applications of work permit which are employer specific under the Impact Assessment of Labour Market (LMIA) exemption which also includes NAFTA and the overseas mobility applications.

This latest electronic system further clarifies and compliments the previous changes that were brought into effect in the month of February 2015. The preceding changes needed an employer who is hiring an overseas worker who is qualified for the LMIA exemption, for initiating the process of work permit by first submitting through an email a complete application form IMM5802 and the employment offer to overseas national exempt from the Impact Assessment of Labour Market (LMIA) along with employee compliance fee of USD 230 wherever applicable.

CIC introduced changes to the work permit applications under LMIA exemption

From the month of February 2015, these compulsory steps will be followed before a overseas citizen can apply for the work permit under LMIA exempt at the visa office or at the port of entry in Canada.

Under this new system, CIC does not need the submission of email of the IMM 5802 employment offer form. Instead, the employers would submit their applications through an employer portal. The employer portal is accessed by either GCKey or sign in partner service that all the employers who are hiring under the LMIA exemption should register. The portal for employer application should be submitted before the submission of application for work permit. After submission, the employment offer id number will be assigned to employer on behalf of overseas worker. The overseas national ID would be included along with the application for work permit for enabling the assessment.

CIC has also formed a period of transition for implementing the new system for employer portal.  For the employers who have submitted the requested documents through the mail  before 26TH October 2015, the overseas worker will have till 21st November 2015 for submitting the application for work permit. If the application for work permit is not obtained before this date, then the employer must again submit the application using the latest employer portal.
