Hundreds of prospective migrants will be expected for taking part in an action of High Court against the decision made by the federal government of cancelling their visa applications under skilled migrant category
An immigration lawyer from Sydney told reporters that he has been waiting for the advice from the senior counsels with regards to the class action against the decision from Michaelia Cash, Former Assistant Immigration Minister for limiting the approvals for certain visas and also cancelling the applications who are still under consideration.
The lawyer said that the immigration is in for the fight. He also said that they will be launching the action before the end of this month and that they are anticipating and they will have hundreds and also hoping to have thousands of participants.
The previous month, the Immigration Department announced that it had visa approvals which are limited and will also cease the application process for three visa types under skilled migrant category. They are as follows: subclass 175 Skilled Independent visa, subclass 475 Skilled Regional Sponsored visa and subclass 176 Skilled Sponsored visa.
According to a statement made by the Immigration Department, it said that the limit sets the highest amount of places that is granted in the financial year 2015-16 for these visa subclasses. That total has been reached already. So, applications for those visas that were not finalized before September 22nd, 2015 taken but not for having been made and application charge for the visa will be paid back to those applicants who got affected.
It has been believed that few applicants had made to wait for up to eight years for getting their application processed.
