USCIS held teleconference on filing annual Form I-924A for EB-5 regional centers

USCIS recently held a teleconference as part of the series for providing information on EB-5. It was mainly concerned on the time of filing the form I-924A that should be filed yearly for demonstrating the eligibility for the designation as the regional center.

USCIS also indicated that the regional centers can file the I-924A form for  a year reporting period or for multiple years reporting period.

For completing the form I-924A, certain information in part 3 should be provided for reporting period. The information that should be provided is: the quantity of money invested through regional center, name, address and title of industry category of every job creating enterprise which is located in regional center’s area, total new jobs directly or indirectly created through regional center, number of jobs that are maintained in the troubled business through regional centers and the number of revoked, denied or approved I- 829 and  I-526 petitions that are filed by the investors under EB-5 through regional center.

The I-924A form is crucial because in demonstration the eligibility for the ongoing designation as the regional center, every regional center should continue promote the economic growth and development, enhanced regional productivity, and enhanced local capital investment in the geographical area of the center.

The regional centers which are designated on or before 30th September 2015, would require to submit their I-924A form by 29th December 2015. The form must be filed during two periods if asked by the USCIS. There is no fee for filing the I-924A form and all the I-924A forms and the supporting documents should be filed with the USCIS at Service Center of California. Forms that are filed to the office of the Immigration Investor Program in Washington DC will be rejected. Failure to file the form in proper manner will result in USCIS issuing a intent to terminate notice to the designation of the regional center, which will serve to terminate the program participation. The USCIS will be issuing the notice with receipt until it rejects. If required email the customer service if receipt notice does not received after three weeks.  USCIS also need the original signatures.
